A NSW upper house committee will this week examine the bill decriminalising abortion in the state after its passage through the lower house.

A NSW upper house committee is set to examine draft legislation taking abortion out of the state's criminal code after the bill passed through the lower house.

Members of the NSW Legislative Assembly erupted into cheers on Thursday night when they voted 59 to 31 in favour of the Reproductive Health Care Reform Bill 2019.

The bill allows terminations up to 22 weeks, as well as later abortions if two doctors considering all the circumstances agree the termination should occur.

It will head this week to the upper house's Standing Committee on Social Issues, who must report back their findings by August 20.

It will then go to the Legislative Council for consideration and a vote.

In the lower house, the bill was backed by Premier Gladys Berejiklian, her deputy John Barilaro and Opposition Leader Jodi McKay.

But Treasurer Dominic Perrottet, Corrections Minister Anthony Roberts, Attorney-General Mark Speakman and Planning Minister Rob Stokes all voted against the bill.

Labor upper house member Penny Sharpe, one of 15 co-sponsors of the bill, said she was "cautiously optimistic" it would pass the Legislative Council but there were some "very strong people who are very opposed".
